Bayh Dole Act:   


The Patent and Trademark Law Amendments Act, more commonly known as the Bayh-Dole Act, and amendments included in P.L. 98-620, enacted into law in 1984.The Bayh-Dole Act is a guide to the Law and Implementing Regulations.

35 U.S.C. §§ 200-211 provides the statutory basis and framework for federal technology transfer activities, including the patenting and licensing of federally funded Inventions by recipient organizations. The Act permits recipients of federal grants and contracts to retain title to patentable "subject Inventions" that arise with the use of federal funds. Where recipients elect to retain title, the Act requires recipients to file patent applications, seek commercialization opportunities, and if requested by the funding agency, to report all efforts to protect or to commercialize these Inventions back to that funding agency. The Act also reserves for the government certain rights in subject Inventions, including (but not limited to) the right to claim ownership of any subject Invention, upon written request.


Best Mode

Patent Law requires that a patent application include the best mode in the description of the invention.  The best mode is the best way that the inventor considers at the time of filing the patent application for making and using the claimed invention.


Berne Copyright Convention

An international treaty extending copyright protection in member countries to nationals of other member countries.


Blackout Period

The period between the dates of USPTO's examining attorney approves a trademark for publication and the date of issuance of the Notice of Allowance from the USPTO. The applicant may not file an Allegation of Use during this period.


Boolean

Boolean logic (named for the British-born Irish mathematician George Boole) is way to express relationships in logic arguments using the following three operators:


*      "and",

*      "or",

*      "Not".


The patent search systems use "AND", "OR", and "ANDNOT" as Boolean operators, in combination with parentheses to build nested logical subsets - example: needle ANDNOT ((record AND player) OR sewing), which would return anything with the word "needle" in a document as long as it does not also contain the word "record" and "player" in the same document or the word "sewing" in the same document. . It also uses some symbols such as "->" to indicate a range, where you enter the field code and start date, ->, and then the end date - example: ISD/1/1/1995->2/14/1995.
